by Justin Dove, Investment U Research Wednesday, June 22, 2011 It’s hard to imagine Google (Nasdaq: GOOG) making mistakes. They haven’t made many, but this one could hurt if Oracle (Nasdaq: ORCL) gets its way. Oracle claims that Google infringed upon Java patents when creating its successful Android mobile device platform. And now, it’s become a major patent lawsuit. Google could stand to lose up to $6.1 billion, plus court costs, if they lose. But a ruling in Google’s favor may seriously hinder the future relevance of Sun Microsystems, Inc. and hurt Oracle’s stock… Did Google Create Dalvik to Avoid Java’s Virtual Fees? Many products such as the Amazon (NYSE: AMZN) Kindle and Apple (NYSE: AAPL) iPhone use Java’s virtual machine; however, the use of this virtual machine requires licensing

Oracle Corp. (ORCL) has been sued by Hewlett-Packard Co. (HPQ) better known as HP, claiming breach of contract and anticompetitive behavior. The legal suit was filed on the basis of a formal legal demand, which HP sent to Oracle on June 8, 2011, asking the latter to reverse its decision regarding the discontinuing support for the Itanium-based servers. In the lawsuit filed at the state court in San Jose, California, HP has accused Oracle of contract breach related to the development of software for the Itanium-based HP servers. HP has also alleged that Oracle is persuading customers to replace their Itanium-based HP servers with Sun servers. However, Oracle has denied the allegations and said that the formal agreement with HP does not include a guarantee of continued support for Itanium-based

Oracle Corp. (ORCL) recently announced that one of the leading retail and commercial banks of Brazil, Banco Santander has chosen Oracle Exadata Database Machine to integrate the operations of Banco Real, which it acquired in August 2009. The Brazilian division of the Spain-based global financial services firm was facing integration problems due to the huge amount of data that it was required to handle after the merger. The challenges faced by the company included growing data volumes, inadequate processing speeds, lengthy batch processes and space limitations in their data center, which were impacting Santander’s regular operations, reputation and revenue growth. Banco Santendar’s migration to Exadata has resulted in the consolidation of servers that led to a significant decline in infrastructure costs.
Oracle Corp. (ORCL) is scheduled to release its third quarter 2011 results on March 24, 2011, after the market closes. Since the release of second quarter 2011 results, Oracle shares have risen 4.0%. Oracle posted decent second quarter results, which beat the Zacks Consensus Estimate by a penny. Not that good, considering the fact that it beat the Zacks Consensus Estimate by 10.8% on an average in the last four quarters. However, third quarter guidance was robust, primarily reflecting higher business spending by corporations. Oracle expects to gain from a strong software business (65.5% of second quarter total revenue) in the upcoming quarters. Second quarter Synopsis Oracle reported strong second quarter results, with earnings per share (excluding one-time items but including stock-based compensation) increasing 32.4% year over year to 49

According to Reuters, Lawson Software (LWSN) is exploring possibilities of selling its software business. The rumors of the sale led to a 13.26% surge in the stock price on March 8, 2011, which closed at $11.19. The stock further gained 0.27% in after market trading. Lawson has hired Barclays Capital, a division of Barclays PLC (BCS) to explore strategic alternatives for the same. The company is also contemplating retaining its existing business and strengthening it by further acquisitions. In 2010, Lawson acquired Healthvision Solutions Inc. for $160 million. Based in Dallas, Healthvision is a privately-held company providing integration and application technology and related services to hospitals and large healthcare organizations. Most recently, Lawson completed its acquisition of privately held Enwisen for $70 million. California-based Enwisen is a leading software-as-a-service provider

Software giant Oracle Corp. (ORCL) has agreed to pay $46.0 million to settle a kickback suit against Sun Microsystems. Oracle declined to comment. The suit was filed back in 2004 in the federal court of Arkansas. The lawsuit alleged that Sun improperly paid kickbacks to systems integrator companies, like Accenture PLC (ACN), in return for recommendations that federal agencies buy Sun’s products. In 2007, the U.S. government became a party to the suit. In this context it is worth noting that in April 2009, Oracle announced the acquisition of Sun Microsystems for $7.4 billion ($9.50 a share) or $5.6 billion net of Sun’s cash and debt. Oracle also settled claims that Sun provided incomplete and incorrect information to the government officers during contract negotiations in the late 1990s. U.S. Postal

by Tony D’Altorio, Investment U Research Wednesday, January 12, 2011 German software company SAP ADR (NYSE: SAP) struggled with management issues throughout 2008 and 2009. Naturally, that uncertainty affected its customers and employees. So in February 2010, the newly appointed co-CEOs – Bill McDermott and Jim Hagemann Snabe – vowed to change things. In their favor, they actually do seem to have boosted employee performance and morale. But placating shareholders has proved a far less simple challenge to master. And if they can’t master it soon, the company might fight itself under new management once again. Is SAP a Takeover Candidate? SAP has to convince its three founders – with their combined 24% of shares – about SAP’s stand-alone strategy. Otherwise, it could become a takeover candidate.
Software giant Oracle Corp.’s (ORCL) second quarter fiscal 2011 earnings and revenues easily outpaced the Zacks Consensus Estimates on the back of strong new software license sales (sales to new customers) and growth in hardware sales, boosted by the acquisition of Sun Microsystems in January this year. The results indicate increased business spending by corporations. However, both new license revenue and total revenue were adversely affected by 2% due to foreign exchange headwinds.
Oracle Corp.‘s (ORCL) fourth quarter 2010 earnings beat the Zacks Consensus Estimate on the back of strong new software license sales and growth in hardware sales, boosted by the recent acquisition of Sun Microsystems. We believe Oracle’s better-than-expected results were aided by the improving IT spending environment. Earnings (excluding one-time items but including stock-based compensation expenses) of 58 cents per share were up 31.8% from the year-ago period of 44 cents and 6 cents above the Zacks Consensus Estimate of 52 cents. Net income rose 30.6% to $2.93 billion from the year-ago period. The rise in earnings was attributable to higher revenues from new software license sales (sales to new customers), which grew for the third consecutive quarter. This shows that demand for software is picking up. Despite foreign exchange

Earlier this year, SAP ADR (NYSE: SAP) reported a 28% drop in annual software sales. Needless to say, investors in the company were not pleased. So it let CEO Leo Apotheker go, and welcomed Bill McDermott and Jim Hagemann Snabe on board to share authority in his place. Since SAP hadn’t made any deals for nearly three years, it had €3 billion in its piggy bank. That didn’t last very long though. The new leadership quickly spent all of that plus some in a $5.8 billion deal for Sybase (NYSE: SY). That bold move marked the second largest deal the company had ever made. It came second only to the $6.1 billion acquisition of Business Objects in 2007. SAP paid a generous 44% premium for Sybase – $65 a share
