Recently, AstraZeneca (AZN) announced that US District Court for the District of Columbia has dismissed the lawsuit filed by the company against the US Food and Drug Administration (FDA). AstraZeneca had taken legal action against the FDA, challenging the agency’s decision to reject AstraZeneca’s Citizen Petitions. The Citizen Petitions were filed by the company for Seroquel (quetiapine fumarate) and Seroquel XR. The Citizen Petitions were filed to bar the FDA from approving any generic versions of the drug that do not include warnings related to hyperglycemia and suicidality in its label. With this move, AstraZeneca was looking to delay the launch of generic versions of Seroquel considering the company has marketing exclusivity for the data associated with the hyperglycemia warning till December 2, 2012. Meanwhile, the UK High Court has

(TEVA) has been pretty active on the generic product launch front with the company launching several generic products in the last few weeks. Among recently launched generic products are Teva’s generic versions of Sanofi’s (SNY) high blood pressure drugs, Avapro and Avalide, AstraZeneca’s (AZN) schizophrenia treatment, Seroquel, and Forest Laboratories’ (FRX) Lexapro. While Teva will enjoy a 180-day period of marketing exclusivity where the generic launches of Avapro, Avalide and Lexapro are concerned, we note that other generic players like Dr. Reddy’s Laboratories (RDY) and Mylan (MYL) have also launched their generic versions of Seroquel. As per IMS data, annual US sales of Avapro, Avalide, Seroquel, and Lexapro were $464 million, $124 million, $4.6 billion and $2.9 billion, respectively. The company and partner Gedeon Richter Plc. announced that their late-stage anti-psychotic candidate, cariprazine, met its primary endpoint in two phase III studies. The studies were conducted to evaluate cariprazine for the treatment of acute exacerbation of schizophrenia. Results showed that patients in the cariprazine arm achieved a significant improvement in symptom compared to patients in the placebo arm. Statistically significant separation from placebo was observed in all doses from week 2 and at each subsequent time point. Forest Labs and Gedeon said that the higher dose showed separation as early as week 1 of treatment. The results were similar to data presented earlier from a phase IIb fixed-dose placebo-controlled study. The company holds immense potential as many blockbuster drugs have begun to go off-patent and many more will lose patent exclusivity in the next few years. Moreover, we are encouraged by Mylan’s geographic reach and product depth along with a robust generic product pipeline. We believe the generic segment will post strong sales in 2012 benefiting from a slew of product launches already lined up. We have therefore upgraded our rating on Mylan from Neutral to Outperform to reflect our overall bullish stance for generic makers. Our target price for the stock is $26.00.
With 2011 coming to an end, the pharmaceutical industry continues to face challenges like sluggish prescription trends, EU pricing pressure, intensifying generic competition, pipeline failures and limited late-stage catalysts. The next five years are expected to reflect a significant imbalance between new product introductions and patent losses. All these factors will lead to a slowdown in global pharmaceutical market growth in the next five years, with major revenue-generating drugs like Lipitor, Plavix, Lexapro and Zyprexa losing exclusivity. In fact, by the end of 2011, drugs worth more than a total of $30 billion will lose patent protection. This includes drugs like Lipitor, Zyprexa and Levaquin. The effect of the genericization of these products will be felt mostly in 2012, which will be a challenging year for several companies. At the

According to Irish orator, philosopher, & politician Edmund Burke, change is the most powerful law of nature. The winds of change seem to be sweeping across the pharmaceutical industry as well. Until recently, most commercialization efforts were focused on the U.S. — the largest pharmaceutical market — along with Europe and Japan. However, with factors like pricing pressure in the European Union (EU) and intensifying generic competition affecting sales in large pharmaceutical markets, many leading players in the pharmaceutical space such as Pfizer (PFE), Bristol – Myers Squibb Company (BMY), Merck (MRK), Eli Lilly (LLY), GlaxoSmithKline (GSK), Astra Zeneca (AZN) and Sanofi-Aventis (SNY), have shifted their focus on emerging (“pharmerging”) markets. The key emerging markets targeted by big players in the pharmaceutical space (aka “Big Pharma”) include China, Russia, Brazil,

November 30, 2011 was a big day for Pfizer, Inc. (PFE) with its blockbuster cholesterol drug, Lipitor, losing exclusivity in the US. With so many drugs losing exclusivity, why is the loss of exclusivity of Lipitor such a major event? Well, Lipitor has been a huge revenue generator and its loss of exclusivity could very well represent the biggest generic opportunity in recent times. Lipitor sales came in at $10.7 billion in 2010 with sales for the first nine months of 2011 coming in at $7.6 billion. Pfizer Goes Aggressive Typically, whenever a branded drug loses exclusivity, it witnesses a rapid erosion in sales with the entry of generic versions. However, Pfizer is trying to turn the tide in its favor by adopting several steps to minimize the impact of

The pharmaceutical industry continues to be impacted by major issues such as sluggish prescription trends, European Union (EU) pricing pressure, intensifying generic competition and limited late-stage catalysts. The next five years are expected to witness a significant imbalance between new product launches and patent expirations. All these factors will lead to a slowdown in global pharmaceutical market growth in the next five years. Major revenue generating drugs like Lipitor, Plavix, Lexapro and Zyprexa are expected to confront generic competition over the next five years. In fact, revenues in excess of $30 billion are expected to be lost in 2011 itself due to key drugs like Lipitor and Zyprexa going off-patent. The impact of the genericization of these drugs will be felt significantly in 2012, which will be a challenging year

(MNTA) and Mylan Inc. (MYL)/Natco Pharma Ltd. The lawsuit is regarding the company’s lead drug Copaxone, marketed for the treatment of multiple sclerosis (MS). The Court adopted all relevant claim construction interpretations of Teva and rejected all the claim construction interpretations put forth by Novartis/Momenta and Mylan/Natco. Moreover, the Court denied Mylan’s motion for summary judgment that the disputed patents are invalid for indefiniteness. We note that Teva’s patent for Copaxone is set to expire in 2014.
Mylan Inc. (MYL) received some good news recently when a US District court denied Teva Pharmaceuticals Industries’ (TEVA) motion for a summary judgment, finding no inequitable conduct in the Copaxone infringement lawsuit. The court has ordered that the trial for inequitable conduct defense will commence on July 11, 2011. The remaining issues will be tried from September 7, 2011. Teva is challenging Mylan’s application for making a generic version of Teva’s Copaxone, a top selling drug for the treatment of multiple sclerosis. Copaxone loses patent protection in 2014. In December 2010 Teva filed a Citizen Petition (CP) with the FDA asking the agency to refuse approval to generic versions of Copaxone. The company said that any generic version of Copaxone should be subject to pre-clinical studies as well as full-scale

Challenges like sluggish prescription trends, EU pricing pressure, intensifying generic competition, pipeline failures and limited late-stage catalysts continue to impact the pharmaceutical industry. The next five years are expected to reflect a significant imbalance between new product introductions and patent losses. All these factors will lead to a slowdown in global pharmaceutical market growth in the next five years. Products like Lipitor, Plavix, Lexapro and Zyprexa are expected to face generic competition over the next five years. In fact, 2011 itself will see drugs worth more than $30 billion losing patent protection. This includes drugs like Lipitor, Zyprexa and Levaquin. The effect of the genericization of these products will be felt mostly in 2012, which will be a challenging year for several companies. At the same time, new products are

We are maintaining our Neutral stance on Endo Pharmaceuticals (ENDP) with a target price of $44.00. Headquartered in Chadds Ford, Pennsylvania and founded in 1997, Endo Pharma is a specialty healthcare solutions company. The company, which operates in the US, reports results through three segments: Branded Pharmaceuticals, Generics and Devices and Services. Endo Pharma offers more than 175 products in the areas of pain management, urology and oncology. In April 2011, Endo Pharma reported its first quarter 2011 results. First quarter adjusted earnings of $1.00 per share were in line with the Zacks Consensus Estimate but $0.26 above the year ago figure. The Medicines Company reported a first-quarter profit of 60 cents per share, well above the Zacks Consensus Estimate of 39 cents and the year-ago profit of 19 cents. Performance was boosted by higher revenues. Revenues, up 9.8% at $112.1 million, surpassed the Zacks Consensus Estimate of $110 million. The Medicines Company’s lead product, Angiomax (bivalirudin), is a specific and reversible direct thrombin inhibitor that was launched in early 2001. Despite the challenging economic scenario which has led to hospitals and patients cutting down on costly procedures, Angiomax sales in the first quarter of 2011 were up 9.7% year over year in the US. The approval, however, comes with a boxed warning and a Risk Evaluation and Mitigation Strategy (REMS). The boxed warning relates to QT prolongation, Torsades de pointes, and sudden death. In addition to achieving the primary endpoint of progression-free survival, vandetanib also showed improvement compared to placebo in the secondary endpoints, which were objective response rate and disease control rate. (CEPH) recently announced the completion of its acquisition of Mepha AG, a privately-held Swiss generic drug company, for CHF 662.4 million (approximately $615.4 million). This acquisition marks Cephalon’s entry in the generics market. This deal is in-line with Cephalon’s goal to reduce its dependence on its central nervous system (CNS) franchise for long-term growth. As such, Cephalon is looking to supplement long-term growth by acquiring/in-licensing products. The Mepha acquisition will not only allow Cephalon to enter the generic drug market, it will also allow the company to
