Yesterday in a speech, Federal Communications Commission (FCC) Chairman Julius Genachowski has recommended a new rule to apply net neutrality to all telecom and cable service providers. Net neutrality will prohibit internet service providers (ISP), especially the phone and cable companies, from discriminating against users or applications. ISPs must grant consumers equal access to all legal web applications and services. The rule was so far applicable to the wired services providers, but the new proposal from the FCC wants to bring the flourishing wireless industry under scrutiny. The FCC’s new proposal is, in general, bad news for large telecom and cable operators like AT&T (T), Verizon Wireless (VZ), T-Mobile, a division of Deutsch Telekom (DT) and Comcast Corp. (CMCSA). As of now, these companies can restrict any devices, applications, services,

Google (GOOG) recently made an interesting move regarding its online books. The company has decided to make 2 million previously scanned books in the public domain available to On Demand Books, the maker of the recently publicized Espresso Book Machine. This would enable the owner of an Espresso Book Machine to identify the digital content, print on standard paper, bind and deliver over the counter to a customer in less than five minutes. The store/library/university would not need to maintain an inventory of books, although it would need to maintain an inventory of printing materials. The concept is of great benefit to consumers as even rare books produced under this model will be available with minimum hassle. Currently, digital books can be read online on Amazon’s (AMZN) Kindle or Sony’s

The U.S. e-commerce market is heating up, with new competition from China-based Alibaba.com. Alibaba Group CEO Jack Ma recently announced that its new business-to-business (BTB) e-commerce platform is currently in the beta stage and could be expected to launch in the U.S. by the end of the year. This seems to be a good time to launch the site since traffic may be expected to increase as a result of the holiday season. However, the company’s entry will no doubt increase competition for existing players such as Amazon.com (AMZN), eBay Inc. (EBAY) and Wal-Mart Stores Inc. (WMT). Still, online retail is one of the few markets that are expected to continue growing this year. According to Forrester Research, non-travel ecommerce sales in the U.S. are expected to grow 11% in

Amid a buzz of publicity, yesterday was the day that many Beatles fans had eagerly waited for, with the release of a new video game in the band’s name – “The Beatles: Rock Band.” If you’re not familiar with the “Rock Band” concept, it’s a bit like karaoke, except you play music in addition to singing. Gamers follow along with their favorite musicians/songs, using an electronic drum kit and guitar, and sing the songs, too. The game is enormously popular, having generated over $1 billion in revenue. And gamers can download individual songs, albums, or catalogs of groups like AC/DC, The Who and The Grateful Dead. So far,

The European Commission is considering the implications of the Google (GOOG) Books deal for European publishers. If the agreement goes into effect in the U.S., it would put European students, scholars and academics at a serious disadvantage. This is because many out-of-print publications would become available to the U.S. public that would remain unavailable to Europeans. The difference in copyright laws in the U.S. and Europe further widens the gap. Books published before 1923 are considered to be out of copyright in America and could, therefore, be scanned by Google, whereas in most European countries they have to be published before 1870 to qualify. The Commission has highlighted the need for increased book digitization in European Union (EU) member countries. The EU has its own publicly funded digital publishing project

The opposition against Google’s (GOOG) book digitization program is strengthening. The New York Times has come out with a story stating that Microsoft (MSFT), Yahoo! (YHOO) and Amazon (AMZN) have entered the fray. While Amazon management avoided comment, Microsoft and Yahoo expressed their dissension by joining an association called the Open Book Alliance. The obvious intention of the association is to increase pressure on the Justice Department, which is currently considering the case. The department is expected to award a decision on October 7. As it happens, the book deal affects different sections of the population. The first section comprises the competition, which is wary of Google’s prowess in the search market. Their fear is that Google will use information on what people read to further improve and strengthen its

The key verticals for IBM in the Indian market are infrastructure, such as construction and steel; telecom; industrial; energy and utilities. It also witnesses growth in the insurance and banking, travel and transportation, and the government spaces. We therefore favor IBM for its wide range of products and large international exposure. IBM generates over a billion dollars in revenue from the Indian market. Revenue at IBM was driven by double-digit growth in markets such as India and China, which were up 10.0% in 2008. IBM expects these growing markets to drive revenue and increase growth beyond 2009. In comparison to the slowing U.S. markets and weak IT spending, the Indian market

Rumor has it that Apple (AAPL) might extend its digital payment processing business by allowing current iTunes Store account holders to purchase digital goods Incorporatedluding movies, TV shows and iPhone apps from third-party wholesalers, resellers, and value-added resellers. We believe that Apple’s idea is to expand the iTunes platform to other third party vendors selling through other gateways in order to earn a sideway income from these purchases. This new line of business may not be good for Apple as payment processing fees are relatively low particularly for cheaper goods. As a strategy, Apple drives higher-margin business and has succeeded in this respect so far. However, even if this new line of business helps in increasing volumes, we feel that cost per transaction is likely to be high and this might

If somebody were to ask you what your best stocks are, you would likely name the stocks moving up the most in your portfolio. Your worst stocks? The ones going lower of course. Simply put, the winners in your portfolio are the ones going up. Period. You’ll rarely single out one of your best stocks just because it has a low P/E ratio or just because it has a great return on equity. Yes, those things do matter! But if the stock is underperforming the market, or worse, going down, you’ll quickly identify it as one of your worst holdings – and you would be right to do so. Now take a look at your portfolio. You probably have some great winners in there. (You better after last month’s run-up.)

by David Fessler, Advisory Panelist, The Oxford Club It’s taken a dismal economy to do it, but Americans are finally saving more and spending less. A lot less. According the Commerce Department’s most recent report, consumers slashed spending for an unprecedented sixth straight month in December. They’re driving less. They’re eating out less. They’re spending less on big-ticket items… And based on sales, they’re spending more at the pair of price-friendly “stores” below -companies still growing, despite – indeed, because of – nationwide economic woes. That’s great news for shareholders. Like consumers, investors have become “spending conscious,” too. They have an estimated $5.6 trillion in cash right now. And once they start deploying all that money, much of it will undoubtedly hit these two stocks. E-Commerce is Booming For Amazon.com
