Mylan, Inc. (MYL) is one of the leading players in the US generics market. The company holds immense potential as many blockbuster drugs have begun to go off-patent and many more will lose patent exclusivity in the next few years. Moreover, we are encouraged by Mylan’s geographic reach and product depth along with a robust generic product pipeline. We believe the generic segment will post strong sales in 2012 benefiting from a slew of product launches already lined up. We have therefore upgraded our rating on Mylan from Neutral to Outperform to reflect our overall bullish stance for generic makers. Our target price for the stock is $26.00.
The legal tussle between Watson Pharmaceuticals Inc. (WPI) and Shire plc (SHPGY) intensified, with the latter filing a patent infringement case against Watson Pharma relating to Vyvanse. Vyvanse is indicated for the treatment of attention deficit hyperactivity disorder (ADHD) in children aged 6 to 17 years and adults. The lawsuit comes in response to the abbreviated new drug application (ANDA) filed by Watson Pharma with the US Food and Drug Administration (FDA) to market a generic version of Vyvanse. We note that the marketing exclusivity for Vyvanse expires in February 2012, under the Hatch-Waxman Act. By filing a patent infringement lawsuit, Shire has ensured a 30-month stay by the FDA. Consequently, the ANDA cannot be cleared by the regulatory body before August 23, 2014 or until a court ruling, whichever

Par Pharmaceutical Companies, Inc. (PRX) is in for a strategic assessment as it announced restructuring plans for its branded drugs segment, Strativa Pharmaceuticals. The company will reduce its workforce by about 100 people as a result of the restructuring, which is expected to drive the Strativa business to profitability. The workforce reduction will help Par Pharma focus on its products, Megace ES and Nascobal. Consequently, in the second quarter of 2011, Par Pharma will incur one-time non-cash charges along with severance costs. The restructuring initiative is expected to generate operating expense savings of $8-$12 million for the rest of 2011. The company believes this initiative will boost Strativa to profitability in the near term. We expect the restructuring program to benefit the company, which witnessed a 20.9% drop in revenues

Mylan Inc. (MYL) received some good news recently when a US District court denied Teva Pharmaceuticals Industries’ (TEVA) motion for a summary judgment, finding no inequitable conduct in the Copaxone infringement lawsuit. The court has ordered that the trial for inequitable conduct defense will commence on July 11, 2011. The remaining issues will be tried from September 7, 2011. Teva is challenging Mylan’s application for making a generic version of Teva’s Copaxone, a top selling drug for the treatment of multiple sclerosis. Copaxone loses patent protection in 2014. In December 2010 Teva filed a Citizen Petition (CP) with the FDA asking the agency to refuse approval to generic versions of Copaxone. The company said that any generic version of Copaxone should be subject to pre-clinical studies as well as full-scale

The company had earlier guided towards earnings in the range of $2.50 – $2.58 per share. Watson also announced that it expects revenues to increase 9% year over year to $2.7 billion in 2009. The company’s shares reacted positively to the news, with the stock gaining roughly 3.5% since the announcement. The statement, which was made at the 28th Annual J.P. Morgan (JPM) Healthcare Conference, is based on a preliminary review of the company’s performance in the fourth quarter and year-ended December 31, 2009. The company enjoys a strong position in the generics market. We believe the company’s strategy of developing generics that are difficult to formulate or manufacture will help strengthen its position in the market. Going forward Incorporatedreasing awareness about generics, initiatives taken by various government and private agencies encouraging the use of low-cost generics, an aging population and a corresponding increase in healthcare costs, as well as the large number of branded products losing patent protection over the coming years, should lead to continued expansion of the generics market.
We are pleased to hear that Mylan (MYL) has begun to market the generic version of BenzaClin (1% Clindamycin and 5% Benzoyl Peroxide Gel) for acne treatment, which was originally manufactured by Sanofi-Aventis (SNY). The drug has been developed under an agreement between its subsidiary, Mylan Pharmaceuticals and Dow Pharmaceutical Sciences, a subsidiary of Valeant Pharmaceuticals International.
Yesterday, Mylan Inc. (MYL) announced that its Indian subsidiary, Matrix Laboratories, received tentative approval from the US Food and Drug Administration (FDA) under the President’s Emergency Plan for AIDS Relief (PEPFAR) for its generic version of a fixed-dose combination of Efavirenz, Emtricitabine, Tenofovir Disoproxil Fumarate tablets in 600 mg/200mg/300 mg dosage strengths. The decision is in response to an Abbreviated New Drug Application filed by the Indian subsidiary. The tentative approval under PEPFAR is indicative of the fact that the product satisfies all the manufacturing quality, safety and efficacy standards laid down by the agency. The Efavirenz, Emtricitabine and Tenofovir Disoproxil Fumarate combination is the generic version of Gilead Sciences’ (GILD) Atripla tablets used for the treatment of HIV-1 infection in adults. It combines three anti-AIDS medicines into a single,
